Terms of service

TERMS OF SERVICE

The Himalayan Cave LLC
The Himalayan Cave Salt Therapy Spa

Effective Date: October 3, 2026

PLEASE READ THESE TERMS CAREFULLY. By accessing our website, creating an account, purchasing merchandise, enrolling in a membership, purchasing a package, booking an appointment, or using our services, you agree to these Terms and the policies incorporated into them.

If you do not agree to these Terms, do not use the website or complete a purchase or booking.

1. Agreement and Scope

These Terms of Service ("Terms") are an agreement between you and The Himalayan Cave LLC, doing business as The Himalayan Cave Salt Therapy Spa ("The Himalayan Cave," "we," "us," or "our").

They govern your use of our website, Shopify store, customer account, membership portal, appointment and booking tools, wellness services, packages, retail purchases, in-store pickup, shipping, and related services.

Additional terms may apply to a particular membership, service, package, promotion, waiver, or transaction.

When a specific written agreement applies to a transaction, that agreement supplements these Terms and controls for that transaction to the extent of any direct conflict, subject to applicable law.

2. Eligibility and Accurate Information

You must have legal capacity to enter into a binding agreement or have the permission of a parent or legal guardian where required.

You agree to provide accurate, current, and complete information when creating an account, booking an appointment, completing a waiver, purchasing a membership, or placing an order.

You may not impersonate another person, use another person's membership or account without authorization, or provide false information to obtain discounts, member benefits, services, products, or other privileges.

3. Our Services

The Himalayan Cave provides wellness, relaxation, recovery, and spa-related experiences.

Services may include salt therapy and other salt-room experiences, cold- or heat-based wellness services, relaxation services, massage or recovery equipment, and other offerings made available from time to time.

Available services, duration, pricing, equipment, eligibility requirements, operating hours, staff availability, and booking availability may change.

We may modify, replace, discontinue, or temporarily suspend a service when reasonably necessary for safety, maintenance, staffing, business operations, or legal compliance.

4. Wellness and Medical Disclaimer

The Himalayan Cave is a wellness spa.

Unless expressly stated otherwise, our services are not medical treatment and are not intended to diagnose, treat, cure, or prevent any disease, illness, or medical condition.

Information provided on our website, through social media, in marketing materials, by employees, or during a visit is for general wellness and informational purposes only. It is not a substitute for medical advice, diagnosis, or treatment from a physician or other qualified healthcare professional.

Individual experiences vary.

Customer reviews, testimonials, descriptions of wellness experiences, educational information, or references to relaxation, recovery, breathing comfort, or general well-being do not constitute a promise, guarantee, or medical claim.

You are responsible for determining whether a service is appropriate for you.

If you are pregnant, have a medical condition, have recently undergone a procedure, take medication that may affect your ability to safely participate, or have any concern about a service, consult an appropriate healthcare professional before participating.

Nothing in these Terms limits a right or protection that cannot lawfully be waived.

5. Safety, Service Eligibility, Waivers, and Service Sequencing

Certain services may require you to complete an acknowledgment, consent form, health questionnaire, release, or liability waiver before participation.

You agree to provide accurate information reasonably necessary to evaluate service eligibility and to follow posted rules and reasonable staff safety instructions.

We may decline, delay, modify, sequence, or reschedule a service when reasonably necessary for customer or employee safety.

Some services should not be performed immediately before or after other services. We may establish waiting periods or prevent certain service combinations from being booked back-to-back, including when a cold, heat, salt, or other wellness service may reasonably require recovery time before another service.

The ability to select an appointment online does not guarantee that a particular service or sequence is appropriate for every individual.

Failure or refusal to complete a required waiver or follow reasonable safety instructions may result in the service being declined or rescheduled.

6. Appointments and Reservations

Appointments are subject to availability.

You should arrive sufficiently early to complete any required check-in, waiver, preparation, or orientation.

Late arrival may result in a shortened session, inability to enter a session already in progress, or rescheduling when necessary to avoid disrupting other guests.

Appointment times generally will not be extended because of a customer's late arrival.

We may occasionally need to reschedule or cancel an appointment because of equipment problems, staffing, severe weather, power or utility interruption, emergencies, safety concerns, or other circumstances beyond our reasonable control.

If we cancel an appointment, we will provide an appropriate rescheduling opportunity, credit, or refund as applicable.

7. 24-Hour Cancellation and No-Show Policy

Appointments must be cancelled or rescheduled at least 24 hours before the scheduled appointment time.

  • Appointments cancelled or changed with less than 24 hours' notice may be charged up to the full price of the scheduled service.

  • A customer who fails to attend an appointment without cancelling may be charged the full price of the scheduled service.

  • When an appointment was purchased or reserved using a package, membership benefit, promotional credit, or prepaid session, a late cancellation or no-show may cause that session or benefit to be treated as used.

  • Cancelling or changing a membership does not automatically cancel an appointment. Appointments must be separately cancelled or rescheduled under this policy.

These provisions do not limit cancellation, refund, or other consumer rights required by applicable law.

8. Memberships

The Himalayan Cave may offer recurring memberships that provide access to specified services, products, discounts, privileges, booking benefits, or other features.

Membership pricing, included benefits, service allowances, frequency limitations, eligibility requirements, and billing frequency will be disclosed with the applicable membership plan before purchase.

Memberships are intended for the enrolled member and may not be transferred, shared, resold, or used by another person unless the applicable plan expressly permits it.

Membership benefits have no cash value and may be used only while the membership is active and in accordance with the rules for the selected membership tier.

Unused membership services, allowances, or benefits do not automatically roll over to a future billing period unless the applicable plan expressly states otherwise.

We may reasonably verify active membership status before providing member-only benefits, pricing, booking privileges, in-store pickup privileges, or other membership features.

9. Member Self-Service Management

Members manage their memberships through The Himalayan Cave's online membership portal, currently provided through Appstle Memberships and Shopify.

Available self-service functions may include reviewing membership details, updating payment information, cancelling future renewals, and selecting available membership changes.

Members are responsible for maintaining accurate contact and payment information and for reviewing the effective date and price shown for any membership change before confirming it.

10. Membership Cancellation

A member may cancel a recurring membership through the online membership management portal.

A cancellation stops the next scheduled renewal. It does not immediately terminate benefits that have already been paid for.

After cancellation, the member will continue to receive the products, services, privileges, discounts, and other benefits associated with the existing membership through the end of the current paid billing period.

At the next scheduled renewal date:

  • No additional membership charge will be processed.

  • The membership will terminate.

  • Membership benefits will end.

Membership fees already charged for the current billing period are not prorated or refunded solely because a member chooses to cancel before the end of that billing period, except where otherwise required by applicable law.

11. Membership Upgrades

A member may upgrade to an available higher membership tier through the membership management system when that option is available.

An upgrade becomes effective immediately after the upgrade is completed and the applicable payment is successfully processed.

When a member upgrades during an existing billing period, the member will pay the prorated difference between the existing membership price and the new membership price for the remaining portion of the current billing period.

The applicable prorated amount will be calculated through our membership billing system and charged at the time of upgrade.

Once the upgrade becomes effective, the member will receive the benefits of the upgraded tier.

Beginning with the next scheduled renewal, the membership will renew at the then-applicable regular price of the upgraded membership.

The prorated charge applies only to the remainder of the current billing period and does not replace the regular recurring price of the upgraded membership.

12. Membership Downgrades

A member may select an available lower membership tier through the membership management system when that option is available.

A downgrade does not take effect immediately.

The member remains in the existing membership tier and continues to receive the benefits of that tier through the end of the current paid billing period.

The downgrade takes effect on the next scheduled renewal date.

At that time:

  • The existing membership tier ends.

  • The selected lower membership tier begins.

  • The benefits of the new membership tier apply.

  • The member is charged the then-applicable recurring price for the new membership tier.

No prorated refund or credit is ordinarily provided for requesting a downgrade during the current billing period because the member continues to receive the benefits of the existing tier through the renewal date, except where otherwise required by applicable law.

13. Membership Changes and Appointment Eligibility

Membership level may affect included services, service frequency, discounts, booking privileges, retail benefits, pickup eligibility, and other features.

Unless a plan expressly states otherwise, benefits are determined by the membership tier that is active when the benefit is used.

An upgrade may provide access to upgraded benefits once the upgrade is effective.

A scheduled downgrade does not remove the existing tier's benefits until the downgrade becomes effective on the next renewal date.

Previously booked appointments remain subject to applicable membership rules, service eligibility, availability, and the cancellation policy.

14. Automatic Renewal and Recurring Billing

Unless expressly stated otherwise, recurring memberships automatically renew at the frequency disclosed when purchased.

Before enrollment, the applicable membership price, billing frequency, included benefits, and recurring nature of the membership will be disclosed.

By enrolling in a recurring membership and providing a payment method, you authorize The Himalayan Cave and its authorized payment-processing and membership-service providers to charge the stored payment method for recurring membership fees until the membership is cancelled or otherwise terminated.

The renewal date and available membership information will be accessible through the member portal.

Members are responsible for maintaining a valid payment method.

If a recurring payment cannot be successfully processed, membership benefits may be temporarily suspended or terminated in accordance with the membership program and applicable law.

A member may prevent the next recurring membership charge by cancelling the membership before the next renewal is processed.

Cancellation ordinarily does not create a prorated refund of membership fees already paid for the current billing period, except where required by law.

15. Changes to Membership Pricing or Terms

The Himalayan Cave may change membership prices, benefits, or program terms prospectively.

Material changes affecting recurring charges or membership benefits will be communicated as required by applicable law.

A change in the published price of a membership does not authorize an undisclosed charge to an existing member.

Where legally required, affected members will receive advance notice of changes affecting future recurring charges and any required opportunity to cancel.

Changes will not retroactively reduce services or benefits already purchased for the current paid membership period unless reasonably necessary for safety, legal compliance, facility availability, or circumstances beyond our reasonable control.

16. Ohio Statutory Membership and Prepaid Contract Rights

Certain memberships, packages, prepaid services, or similar arrangements may be subject to special consumer protections under Ohio law, including protections that may apply to qualifying prepaid health-spa or similar consumer contracts.

When such laws apply, the customer's statutory cancellation, termination, relocation, disability, death, facility-closure, refund, notice, or other rights will apply regardless of anything in these Terms stating otherwise.

Any separate written membership agreement, statutory Notice of Cancellation, or other document required by Ohio law is incorporated into these Terms.

If these Terms conflict with a consumer right that cannot legally be waived, the applicable law controls.

17. Service Packages and Prepaid Services

Unless the applicable offer states otherwise, prepaid service packages expire one year from the date of purchase, subject to applicable law and any non-waivable statutory rights.

Package sessions and prepaid services are not redeemable for cash except where required by law.

Packages may be subject to booking availability, service eligibility requirements, safety restrictions, membership rules, and appointment cancellation policies.

Specific package terms displayed at the time of purchase form part of the customer's agreement with The Himalayan Cave.

18. Retail Product Sales and Returns

Except where otherwise required by law, retail product sales are final and returns or exchanges are not accepted.

This policy does not eliminate rights or remedies that may apply when:

  • An incorrect item was supplied.

  • Merchandise arrives damaged or defective.

  • We are unable to fulfill an order.

  • A refund is required because of a shipping delay or cancellation.

  • Applicable law otherwise requires a refund, replacement, or other remedy.

Customers experiencing a fulfillment problem should contact The Himalayan Cave promptly so the issue can be reviewed.

Gift cards, promotional credits, and store credits are not redeemable for cash except where required by law.

19. Shipping

The Himalayan Cave ships merchandise only to addresses located within the United States and its territories.

We do not offer international shipping.

Orders may not be placed using a United States address, freight forwarder, package-forwarding company, passthrough address, reshipping service, or similar arrangement for the purpose of ultimately delivering merchandise outside the United States or its territories.

Orders that we reasonably determine are intended for unauthorized international forwarding or re-export may be declined or cancelled.

Free shipping is available on qualifying merchandise purchases over $50, subject to the terms displayed at checkout and the Shipping Policy.

Shipping estimates are estimates rather than guarantees unless expressly stated otherwise.

If we are unable to ship merchandise within a promised time, or within the period required by applicable federal law when no shipping time was stated, we will provide the delay, cancellation, or refund options required by law.

Our Shipping Policy is incorporated into these Terms.

20. In-Store Pickup

When offered through our website, in-store pickup for online retail purchases is reserved for eligible active members.

Non-members purchasing retail merchandise online must use an available shipping option unless The Himalayan Cave expressly authorizes another fulfillment method.

Membership status may be verified before merchandise is released.

If in-store pickup is incorrectly displayed or selected for an order that is not eligible, we may contact the customer to arrange appropriate shipping or cancel and refund the affected order.

21. Orders, Fraud Prevention, and Payment Verification

We reserve the right to refuse, hold, limit, or cancel an order when we reasonably believe additional verification is necessary or when an order presents indicators of fraud, payment abuse, unauthorized resale, prohibited international forwarding, or other suspicious activity.

Indicators may include:

  • Repeated payment attempts using multiple cards.

  • Significant discrepancies between billing and fulfillment information.

  • Attempted use of forwarding addresses.

  • Inability to verify the purchaser.

  • A high-risk fraud assessment from our payment processor or ecommerce platform.

We may request reasonable identity, billing, address, or payment verification before fulfilling an order.

Orders cancelled by us will be refunded as appropriate to the original payment method, subject to payment-processor procedures and applicable law.

22. Pricing, Payment, Taxes, and Errors

Prices are displayed in United States dollars unless otherwise indicated.

Applicable taxes, shipping charges, and other disclosed charges may be added during checkout.

We attempt to keep pricing and product information accurate, but typographical, technical, inventory, or pricing errors may occur.

If an obvious pricing or listing error is discovered before fulfillment, we may cancel the affected transaction and provide a refund rather than fulfill the transaction at the erroneous price, to the extent permitted by law.

Promotions, discounts, memberships, packages, and special offers may have additional eligibility requirements, expiration dates, quantity limits, exclusions, or specific terms.

Discounts may not be combined unless expressly permitted.

23. Gift Cards, Credits, and Promotions

Gift cards, promotional credits, and store credits may be subject to separate terms disclosed when issued or purchased.

They may not be redeemed for cash except where required by law and may not be used in a fraudulent or unauthorized manner.

Promotional offers may be changed or discontinued prospectively.

We may refuse or reverse a promotion when it was obtained through fraud, technical error, duplicate-account abuse, or other misuse, subject to applicable law.

24. Customer Accounts

You are responsible for maintaining the accuracy of information associated with your customer account and for protecting your login credentials.

You may not use another person's account or membership without authorization.

We may suspend or restrict an account when reasonably necessary to investigate unauthorized activity, payment fraud, abuse of membership privileges, misuse of promotions, security concerns, or material violations of these Terms.

25. Minors

Services for children and minors are subject to age requirements, supervision rules, service-specific safety requirements, and any applicable insurance or equipment restrictions.

A parent or legal guardian must provide any consent required for a minor to participate.

Children must remain appropriately supervised when required by our facility or service rules.

We may establish different age requirements for different services based on legitimate safety or operational considerations.

26. Appropriate Conduct and Right to Refuse Service

Customers and guests must treat employees, other guests, equipment, and the facility respectfully.

Harassment, threats, intentional property damage, unsafe conduct, unauthorized recording, interference with another guest's experience, or refusal to follow reasonable safety instructions may result in removal from the facility and restriction from future services.

We may refuse or discontinue service when reasonably necessary for safety, security, employee or guest protection, fraud prevention, or enforcement of these Terms, subject to applicable law and nondiscrimination requirements.

27. Website and Online Service Use

You may use our website and online services only for lawful purposes.

You may not:

  • Interfere with site operation or security.

  • Access another person's account without authorization.

  • Introduce malicious software.

  • Scrape or copy protected content for unauthorized commercial use.

  • Make fraudulent bookings or purchases.

  • Impersonate another person.

  • Misuse discounts or memberships.

  • Use the site in violation of applicable law.

We may restrict access to the website or online account features when reasonably necessary to protect customers, employees, systems, payment integrity, or business operations.

28. Intellectual Property

The Himalayan Cave name, logos, branding, website design elements, photographs, graphics, text, service descriptions, marketing materials, and other original content are owned by or licensed to The Himalayan Cave LLC unless otherwise indicated.

Content may not be copied, reproduced, distributed, modified, sold, republished, or commercially exploited without authorization except where permitted by law.

29. Reviews and Customer-Submitted Content

If you voluntarily provide a review, photograph, testimonial, comment, suggestion, or other content for public posting, you represent that you have the right to provide that content and that it does not violate another person's rights.

We may moderate or decline to publish content that is unlawful, threatening, fraudulent, defamatory, obscene, misleading, contains confidential information, infringes intellectual-property rights, or is otherwise inappropriate for our business channels.

We will not materially alter a customer testimonial in a way that changes the customer's meaning.

30. Electronic Communications and Electronic Records

By using our website, booking tools, customer portal, or online store, you agree that transaction-related notices, receipts, confirmations, membership information, and other records may be provided electronically to the contact information associated with your account.

Marketing email or text messages, when used, are subject to the consent and opt-out choices provided with those communications.

Transactional communications necessary to administer an order, appointment, membership, account, or legal notice may still be sent as permitted by law.

Electronic acceptance of these Terms, a membership agreement, waiver, or other document may be treated as a signature to the extent permitted by applicable law.

31. Third-Party Platforms, Shopify, and Appstle

Our online store is powered by Shopify and may use Appstle Memberships and other third-party services for memberships, booking, payments, waivers, communications, shipping, fraud screening, analytics, or other business functions.

Third-party services may have their own terms and privacy practices.

The Himalayan Cave remains responsible for its obligations to customers but cannot guarantee uninterrupted operation of third-party platforms, payment processors, telecommunications systems, internet services, or other technology outside our reasonable control.

We may change service providers without changing the essential obligations in these Terms.

Links to third-party websites are provided for convenience and do not necessarily constitute an endorsement.

32. Privacy

Personal information collected through our website and services is handled according to our Privacy Policy and applicable law.

Information submitted through a waiver, health questionnaire, booking form, membership account, customer account, or other service may be used as reasonably necessary to:

  • Provide the requested service.

  • Administer the customer relationship.

  • Comply with legal obligations.

  • Maintain business records.

  • Prevent fraud.

  • Protect customer and employee safety.

Our Privacy Policy is incorporated into these Terms.

33. Website and System Availability

We make reasonable efforts to maintain an accurate and functional website, online store, booking system, and membership portal, but do not guarantee that every electronic service will always operate without interruption, delay, or error.

Temporary technical outages do not automatically create a right to compensation except where applicable law provides otherwise.

If a technical issue affects a completed payment, appointment, or membership transaction, we will review the transaction and correct it as appropriate.

34. Disclaimer of Warranties

To the fullest extent permitted by law, the website and its informational content are provided on an "as available" basis.

We do not guarantee that website access will always be uninterrupted, error-free, or free from every technical or cybersecurity risk.

Nothing in this section excludes warranties, remedies, or consumer protections that cannot lawfully be excluded.

35. Limitation of Liability

To the fullest extent permitted by applicable law, The Himalayan Cave LLC will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising solely from use of the website, online store, membership portal, booking platform, or third-party digital services.

Nothing in these Terms is intended to exclude or limit liability that cannot legally be excluded or limited.

Participation in individual wellness services may also be governed by separate acknowledgments, informed-consent forms, or waivers applicable to those services.

36. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless The Himalayan Cave LLC and its owners, employees, agents, and service providers from third-party claims arising from your:

  • Unlawful misuse of the website.

  • Fraudulent activity.

  • Intentional misconduct.

  • Infringement of another person's rights.

  • Material violation of these Terms.

This provision does not require a consumer to indemnify The Himalayan Cave for liability that cannot legally be transferred to the consumer.

37. Events Beyond Our Reasonable Control

We are not responsible for delay or inability to perform caused by events beyond our reasonable control, including severe weather, power or utility interruption, government orders, public emergencies, equipment failures not caused by unreasonable neglect, internet or platform outages, supply disruption, or similar events.

When such an event affects a paid service or order, we will provide the remedy required by applicable law and otherwise work reasonably to reschedule, credit, refund, or fulfill the affected transaction as appropriate.

38. Governing Law and Venue

These Terms are governed by the laws of the State of Ohio, without regard to conflict-of-law principles, except where federal law or another mandatory law applies.

Any legal action relating to these Terms that is properly brought in state court shall be brought in a court of competent jurisdiction in Lake County, Ohio, unless applicable law requires otherwise.

Nothing in these Terms eliminates a consumer protection or other legal right that cannot lawfully be waived.

39. Severability, No Waiver, and Assignment

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed when necessary, and the remaining provisions will continue in effect.

Our failure to enforce a provision on one occasion does not waive our right to enforce that provision or another provision later.

You may not assign or transfer your membership, account, or rights under these Terms except as expressly permitted by us or required by law.

We may assign these Terms in connection with a lawful sale, merger, restructuring, or transfer of the business, provided that consumer rights and prepaid obligations continue to be honored as required by law.

40. Changes to These Terms

We may update these Terms periodically to reflect changes in our services, technology, business practices, or legal requirements.

The updated version will be posted with a revised effective or last-updated date.

Changes will apply prospectively as required by law.

Material changes to an existing recurring membership or other ongoing contract will be handled according to the applicable membership agreement and legal requirements rather than merely by updating this webpage.

41. Related Policies and Agreements

These Terms should be read together with the following documents, as applicable:

  • Privacy Policy

  • Return and Cancellation Policy

  • Shipping Policy

  • Membership Terms or Membership Agreement

  • Service Waivers, Informed Consents, and Acknowledgments

  • Any package-, promotion-, or service-specific terms presented at purchase or booking

When a specific transaction is governed by a separate agreement, the more specific agreement controls that transaction to the extent it does not conflict with applicable law.
